A Nov. 9 nationwide test of the emergency alert system went less than perfectly, according to reports from across the country.
The test, meant to last 30 seconds at precisely 2 p.m. EST and be conducted by all manner of public, cable, satellite and direct broadcasters, ran into snafus across the United States.
Perhaps most infamously, some DirectTV subscribers saw (embedded video) an emergency alert title card, but rather than hearing the emergency alert tone, were treated an excerpt of Lady Gaga's "Paparazzi."
Some Comcast subscribers in Northern Virginia said their Comcast provider switched to home shopping network QVC, according to the New York Times. Some cable customers in Los Angeles said the alert lasted almost 30 minutes, also according to the Times.
MTV didn't appear to run the test at all, according to ABC News.

Raids conducted by Customs and Border Protection agents on public transportation in upstate New York have come to play an outsize and unconstitutional role in Border Patrol activity, says the New York Civil Liberties Union.
In a report released Nov. 9, the NYCLU says arrest statistics it received from the Rochester Border Patrol Station from 2006 through 2009, obtained by a Freedom of Information Act request, show arrests made through identity checks on public transportation jumping from 42 percent of the station's total in 2006 to around 63 percent in 2007 through 2009.
The raids, during which Border Patrol agents board trains and buses "nowhere near the border to question passengers about their citizenship" typically occur many miles from the Canadian border or other port of entry, the NYCLU says.
"They do little to protect the border, but they threaten constitutional protections that apply to citizens and immigrants alike, invite racial profiling, tear apart families and burden taxpayers with the cost of detaining individuals who were arrested while innocently going about their business," the report says.
Federal regulations permit CBP to operate within 100 miles of the international border, but the NYCLU says Border Patrol agents don't have the right to conduct routine searches without probable cause or warrant within that 100 mile area, as they do in permanent checkpoints on the border itself. CBP officials have said their questioning of bus and train passengers is consensual--and, in fact, 95 percent of the 2,743 arrest records obtained by FOIA include a statement that the arresting officer initiated "consensual, nonintrusive" contract or engaged in a "consensual conversation" with the arrestee, the report says.
But the consent is not real and the language is employed to circumvent constitutional protections, the report adds.
"When an armed agent questions passengers on a train or bus, sometimes in the middle of the night with a flashlight glaring at the rider's face, few individuals would feel that they have the right to refuse to answer the agent's questions," it says.

Expedited airport security lines for frequent passengers who undergo pre-screening by the Transportation Security Administration will roll out to an additional three airports in the coming months, TSA Administrator John Pistole told a Nov. 9 Senate panel.
The program, known as PreCheck, will arrive at "select checkpoints" at Las Vegas McCarran International in December and Los Angeles International and Minneapolis-St. Paul International in the first two months of 2012, Pistole told the Senate Commerce, Science and Transportation Committee.  
TSA announced in October the pilot PreCheck programs with airlines at airports in Atlanta, Detroit, Dallas-Fort Worth and Miami.
The goal, Pistole told the committee, is to expand PreCheck "as broadly as possible." Its wider expansion will likely have to wait for high-profile airline mergers to consolidate information technology systems, Pistole added, citing the merger of United and Continental, and Southwest Airline's acquisition of AirTran.
PreCheck must be integrated into the airline ticketing process, Pistole explained, since PreCheck passengers must receive a boarding pass with a machine-readable code on it to go through the special PreCheck screening process.
Those who travel frequently enough, and are lucky enough to join PreCheck, get the privilege of a screening process that permits them to keep their belt on their pants, their shoes on their feet, their jackets worn as they were designed, their laptops in laptop cases and any liquids and gels in their carry-on bag.
Occasionally and at random, however, PreCheck travelers will be told to go through the regular airport security process (beltless, shoeless and jacketless, etc.) as a way of maintaining the factor of randomness in airport security, Pistole added.
TSA also has Known Crewmember security checkpoints operating at seven airports, Pistole said. The program--funded, Pistole said, by the Air Line Pilots Association and the Air Transportation Association of America--permits pilots to go through expedited security. TSA said earlier this year that Known Crewmember ties airline employee databases together, permitting TSA agents to "positively verify identity and employment status of crewmembers."
When it comes to nude images of people passing through x-ray scanners, Pistole said backscatter machines continue to display revealing images of individuals passing through them, rather than the generic figures TSA agents now see in millimeter wave full-body scanners. Pistole said the manufacture of the machines is undergoing software testing with TSA. "They haven't been through that quite yet," Pistole said, adding that about 240 backscatter machines are in use.

Attorney General Eric Holder expressed regret over Operation Fast and Furious but defended efforts to prevent guns from being trafficked to Mexico at a Nov. 8 hearing of the Senate Judiciary Committee.
The Bureau of Alcohol, Tobacco, Firearms and Explosives operation was a sting where ATF officials let suspected arms traffickers buy guns so ATF could track them to Mexican organized crime groups. ATF officials lost track of about 1,400 of the guns, and two were found at the scene of the killing of a U.S. border patrol agent.
"When I saw the indications that guns had walked, I was bothered by it, offended by it, concerned about it, and ordered the inspector general to investigate it," Holder said, adding that he issued a field directive "to make it clear that gun walking was not appropriate."
"It is not fair, however, to assume that the mistakes that happened in Fast and Furious directly led to the death of Agent Terry," Holder said, referring to Brian Terry, the slain CBP officer. 
Holder added that new leadership at ATF has implemented reforms such as stricter oversight procedures for major investigations. He also reiterated that the operation "was a flawed response to and not the cause of the flow of illegals guns" to Mexico, as he urged Congress to provide ATF the resources it needs to combat arms trafficking.
He expressed support for a new rule that requires firearms sellers in the four states that border Mexico to report when someone buys multiple assault rifles in a five-day period.

Iran's questionable nuclear activities have added to the International Atomic Energy Agency's suspicions that its nuclear program is not exclusively peaceful, says a Nov. 8 IAEA report (.pdf).
For example, Iran has developed detonators that are integral to nuclear devices and have few non-nuclear applications, yet has not explained its need for them, the report says. It has also developed a related initiation system, and the IAEA found "strong indications" that a foreign expert who worked on nuclear weapons in his country of origin assisted Iran on the system.
The unnamed expert and other sources verified to the IAEA that he was in Iran from 1996 to 2002, apparently to assist Iran's nuclear program, while he also lectured on explosion physics and its applications.
But "Iran has not been willing to engage in discussion" about the initiation system, the IAEA says.
Iran also covertly built several facilities for uranium enrichment and only declared them to the IAEA once the agency became aware of their existence from outside sources, the report says.
Meanwhile, the agency obtained information that shows that Iran constructed a large explosives containment vessel for hydrodynamic experiments, which are "strong indicators of possible weapon development," the reports says. The IAEA called on Iran to explain what's behind these activities.
A United Nations member state has provided the IAEA with Iranian documents that include logistics and safety arrangements necessary for conducting a nuclear test.
Documents also show that Iran worked on a prototype firing system to explode a payload either in the air above a target or when its re-entry vehicle impacts the ground. In response, Iran called this "an animation game."
The IAEA concluded that the payload in the documents could only be nuclear, and Iran agreed that the documents would constitute a nuclear weapons program "if the information upon which it was based were true," the report says.
But the IAEA expressed doubt that fabrication would be possible, on the basis of the quantity, scope, comprehensiveness and complexity of the documents.

Governments should be careful that rare, atypical terrorist attacks such as those of Sept. 11, 2001 don't have an outsize effect on policy--although, at the same time, governments can't ignore the tendency of terrorism to occur in bursts, said Gary LaFree, a University of Maryland professor.
LaFree, head of the National Consortium for the Study of Terrorism and Responses, said during an Oct. 13 lecture at the University of Nebraska, that Sept. 11 should be understood as both a highly unusual event that one that people reasonably at the time feared was a precursor to additional attacks.
To put the rareness of 9/11 in perspective, 3,369 Americans within the United States have died of terrorist attacks since 1970, with the collapse of the World Trade Center accounting for the vast majority of them. "If you take out the fatalities of 9/11, our fatalities are on a level similar to Canada," he said.
Further, even foreign terrorist groups identified by the State Department as inimical to the United States attack non-U.S. affiliated targets in their home region far more often than they do either the United States itself, or representations of the Untied States, such as embassies or U.S. corporate buildings located abroad, LaFree said.

The Homeland Security Department might propose legislation to place dams under a regulatory regime similar to chemical facilities, says the DHS office of inspector general.
In a report dated Sept. 15 critical of national dam risk management, the OIG says that DHS has failed to conduct security reviews for 55 percent of critical dam assets as of March 2011. The reason for the gap, the OIG says, is that participation in DHS-led risk management activity is purely voluntary for dam owners, and "DHS could not always obtain cooperation."
Even after a risk assessment--which can vary in strength from a survey to a site visits--non-federal dam owners are under no obligation to implement corrective actions identified by DHS personnel, the report says.
DHS officials told auditors that they recently revised the criteria for determining whether a dam is a "critical asset" and so in need of DHS risk management, and that under the new criteria, the proportion of dams assessed by the National Protection and Programs Directorate has gone up.
Auditors, however, say that DHS should consider proposing legislation that would place critical dams under the same regulatory regime as high-risk chemical facilities. The regime is known as Chemical Facility Anti-Terrorism Standards, or CFATS.
DHS officials told auditors they concur, and that the NPPD will make a subsequent recommendation on whether DHS should proceed with proposing legislation.

Prosecutorial discretion by Immigration and Customs Enforcement agents when it comes to deporting illegal aliens hasn't taken root, says a Nov. 9 report from the American Immigration Lawyers Association and the American Immigration Council.
A June 17 memo signed by ICE Director John Morton instructs personnel to take into account factors such as educational attainment, criminal history, age and circumstances of arrival in the United States when deciding to proceed with the removal of an illegal alien.
"The overwhelming conclusion is that most ICE offices have not changed their practices," the report says.
The Obama administration has said its policy is to focus on the deportation of people posing a threat to society since ICE already operates at about its maximum removal capacity of 400,000 individuals a year.
AILA and AIC say they requested feedback from lawyers and other immigration practitioners across the country over a 4-month period starting on June 30 regarding implementation of the discretion policy. Based on 252 cases, the two organizations conclude that ICE generally has not implemented the policy or implemented it inconsistently.
Some immigration attorneys reported that ICE official said they have "no intention of complying and indicated their jobs are to arrest and deport people," the report says. In other cases, ICE officials interpreted prosecutorial discretion far more narrowly than the memo directs, with some stating that they wouldn't consider discretion except in the case of a life threatening situation.
Discretion extends to those convicted of petty misdemeanors, the report says--since the Obama administration has emphasized the protection of public safety and national security in its deportation policy--but many ICE officials also would not grant discretion for anyone with any type of criminal record, the report says.
The report recommends further guidance and training.

During 2010, law enforcement agencies reported 6,628 criminal hate crime incidents involving 7,699 offenses across the United States, the FBI says in a Nov. 14 release of annual crime statistics.
Of the 6,624 incidents involving an incident with a single bias, 47.3 were racially motivated, 20 percent were motivated by religious hatred, 12.8 percent by ethnicity and 19.3 by sexual orientation.
Anti-Jewish and anti-Hispanic incidents were the most common incidents within religiously- and ethnically- motivated hate crimes, the FBI statistic show, constituting 67 percent and 63 percent of those categories, respectively.
Anti-Islamic religious hate crimes accounted for 12 percent of religiously-motivated hate crimes; there were 1,322 total such crimes reported during 2010, the FBI says.

Holders of federal security clearances could become the next class of individuals to receive expedited treatment in Transportation Security Administration airport checkpoints.
"Clearly, that is a category of people that we as a society know and trust more than others," TSA Administrator John Pistole told a Nov. 10 audience at an event hosted by Homeland Security Policy Institute at George Washington University in Washington, D.C.
TSA, he added, is working with the director of national intelligence to explore a way of implementing a system that would permit security clearance holders to typically go through a less intrusive airport security checkpoint.
The TSA earlier this year unveiled an expedited airport security program in four American airports known as PreCheck for frequent passengers who undergo pre-screening and has plans to expand the program to an additional three in the coming months. Right now only frequent fliers of American Airlines and Delta Air Lines, as well as some members of a Customs and Border Protection expedited border crossing program known as Trusted Traveler, can participate in PreCheck.  
PreCheck passengers go through lines that permit them to keep their belts on pants, shoes on feet, light jackets worn, laptops in laptop cases and liquids and gels in a carry-on bag.
During the event, Pistole also said that the TSA behavioral observational technique program rolled out by TSA at Boston Logan and in October to Detroit Metropolitan Wayne County Airport might not be implementable on a nationwide basis. "To try to do over 625 million [passengers] at 450 airports is a significant challenge," he said, citing the monetary concerns and passenger volume.
The program has come under criticism for lacking a scientific basis and for encouraging racial profiling. "We are not in the profiling business," Pistole said. The program's inspiration, a program at Israel's Ben Gurion International Airport, does engage in profiling, Pistole said.
"The Israelis are very upfront about 'We do profile, here's why, there's the threat,'" he said.

AIR TRAFFIC CONTROL

Early History

To get a better appreciation of air traffic control, we have to look briefly into history.   But we needn’t look back too far, for the Wright brothers took off (from Kitty Hawk in 1903, and commercial aviation itself as we know it today began seventy-six years ago in 1935.  Aviation captured the public’s imagination during World War I when such as Von Richthofen, Fonck, Bishop, Ball, Luke, Rickenbacker and Lufbery roamed the skies of France.   Following the war a series of spectacular flying feats brought many others to the attention of the public.
The NC-4 flew the Atlantic nonstop-about 1,700 miles in just under sixteen hours.   Lieutenants Belvin Maynard and Alex Pearson flew coast to coast and back in little more than nine days.   Significantly, a series of airfields had to be strung across the nation so they could land when fuel ran low.   This was the first transcontinental airway.   In 1922, Lieutenant James Doolittle flew from Florida to Texas and on to California in twenty-one hours.   Then came other pioneers:  Carl Spaatz, Ira Eaker, E. R. Quesada, H.  A.   Halversen, Richard E.   Byrd, Floyd Bennett, Wiley Post, Harold Gatty, Amelia Earhart, Jacqueline Cochran, Howard Hughes and Charles Lindbergh.
The U. S. Post Office inaugurated airmail service in 1918, though it wasn’t until 1924 that many of the obstacles were eliminated and the cost reduced to a practical level. Flying the mail in those days took courage.   Pilots flew through snow and rain in an open cockpit with few instruments, an occasional beacon on the ground, a road map for navigation and few airports to land on if engine trouble developed.  In 1925 the Congress of the United States passed the Kelly Act, authorizing the government to contract with private companies for carriage of domestic mail.   Mail routes were established-and airlines began to emerge.   With them came the need for air traffic control.
Navigation, of course, was visual, though clouds and storms often forced pilots to guide themselves by dead reckoning.   In addition to the road map and the occasional beacon light, pilots frequently took their bearings from railway tracks and highways.   Obviously, flying was mostly daytime affair.   Only the more intrepid pushed ahead at night.   Those who had more than a compass, a fuel gauge and an altimeter were considered fortunate.   All was not pure guesswork, however.   In 1919 le Post Office Department had begun investigating the use of radio to guide night flights.   But progress was slow.   In 1921 a pilot named Jack Knight made the first airmail night flight from North Platte Nebraska, to Chicago, using bonfires, flares and an auto map as “navigational aids”.   The rotating beacon light was introduced in the mid-1920s. beacons enabled the mail to be flown by night, but pilots reported the beacons were missed all too easily in poor weather.

The First Control Tower

The first airport control tower in the United States was set up at Cleveland, Ohio in 1927.  A resolute young pilot named Dave Little was instrumental in establishing this tower.   Another major aviation milestone came in 1927 when the LF/MF Four Course Radio Range was introduced by the government.   LF/MF stands for “low frequency /medium frequency”-between 200 and 400 kilocycles-which is the radio frequency band just below the broadcasting band.  Four Course refers to the four radio beams emitted by ground transmitters which could be used as guides for the aviator.   The marker beacon came late in the 1920s.   Pilots used the radio ranges to determine direction and watched for marker beacons to measure progress along that course.   Introduction of radio-telephone shortly after 1930 was hailed throughout the aviation world because it permitted two-way communication by voice for the first time.   Prior to its introduction pilots had to rely on one-way-ground to air-communications in Morse code.   These devices sufficed for most of the 1930s, though midway in that decade an event occurred which was to make the expansion and improvement of air traffic control a necessity.   In June, 1935, American Airlines put the first DC-3 into service.   It was an event which was to revolutionize airlines and air traffic control, for the famous DC-3 was the first plane capable of making money just by hauling passengers.   With the introduction of the sturdy DC-3, commercial aviation came of age in the world.   Airlines blossomed everywhere.   And the need for more and better air traffic control and equipment became acute.   What was needed, in a sense, were highways of the air.
One solution suggested was the installation of additional LF/MF radio ranges to create more airways.   Though this was done to a certain extent, it became impractical over high-density areas because the frequency band quickly became overcrowded.   In addition, the fact that the LF/MF band could easily be jammed by static, leading to a breakdown in communications in bad weather (when it was needed most), led pilots to urge development of other navigational aids.   Though much research was undertaken, little hardware was available until World War II.

New Navigational Aids

The war created a tremendous sense of urgency.   Many new ideas and products were developed “ahead of their time” because of it, and among these were navigational aids.   A myriad of new items were created, produced and tested in a matter of months.   By war’s end much of the hardware was being put to work in behalf of the nation’s private commercial aviation industries.
The first step, and perhaps the most important milestone in twenty years, was the United States government decision to switch from the old LF/MF radio band to the “newer” very-high-frequency band.   Pilots refer to it as VHF.   It may be found just above the band used by FM radio; more precisely the area between 108 and 135 megacycles.   The change was welcomed by flyers for many reasons.   Two reasons were most important.   First, VHF was-and is-almost completely free of static, enabling pilots and air traffic controllers on the ground to communicate virtually any weather.   Second, VHF paved the way for VOR, or very-high-frequency ominidirectional radio range, which was developed by the government and in use by 1940.   Like spokes from the hub of a wheel, the radio range station sends out beams in every direction-it is omnidirectional.   Once on a VHF beam, a lot can determine his bearing to the station transmitting that beam.   Further, he can tell his exact position by comparing the bearings from two such stations, or transmitters.   The old LF/MF system had only four “on the beam” signals.   The superiority of the new system to the old makes it easy to understand the reason pilots were quick to adopt the VHF system.   VHF had still another advantage which appealed to pilots.   When using he old LF/MF systems, flyers had to listen intently to the sound of the beam to tell whether they were on course or not and whether they were going away from the transmitter or flying toward it.   The strength of the sound increased on approaching the transmitting station and decreased when flying away from it.   Although this wasn’t too difficult, VOR was much easier to use.
VOR signals are picked up by a plane’s receiver which is connected to a dial on the instrument panel.   Needles on the dial controlled by the VOR signal tell the pilot his deviation, left or right, from the desired course.   VOR and VHF were vast improvements over the crude instruments of the past.   But it soon became obvious that more information was needed.   With VOR, pilots knew whether they were on or off course by a glance at the VOR indicator, but they had no easy way of determining how far they were from the VOR station.
The first of the newer devices developed was DME, which stands for distance-measuring equipment.   DME allows a pilot to know continuously and instantaneously his distance from a VOR station.   The DME system utilizes a combined receiver and transmitter on the ground and a similar unit in a plane.   The airborne unit is called the interrogator, since it “questions” the ground unit, which is called the transponder.   The plane’s DME unit sends out a signal which is received by the transponder.   The ground unit replies with a similar signal.   The time it takes the signal to make the complete round trip is measured precisely by an electronic figure on a dial mounted in the instrument panel.
Addition of DME has been a boon to aviation, and it gave a definite boost to the growth of commercial airline flying as we know it today.   Since the incorporation of DME, pilots and flight crews manage their plane with safety in virtually any type of weather, night and day.   The combined elements are known as VOR/DME.   With this combination of distance-measuring and very-high-frequency course-indicating equipment, pilots can tell at a glance their direction to a station, their distance to or from it, and, with the help of their air speed indicator, their rate of progress.
A similar system, called TACAN, for Tactical Air Navigation, has been developed by the military.   There is one major difference between TACAN and VOR/DME: the former operates in an ultra high-frequency band.   Other major elements in the system are similar to DME.   Shortly after the introduction of TACAN a controversy developed over which system should be used and a compromise solution was agreed upon.    The two have been combined and put into operation for joint use.   Under the compromise both the TACAN and VOR transmitters are used to provide directional guidance, while the TACAN transmitter is used to determine the necessary distance-measuring data.   The combined system is known as VORTAC.   It is the basic unit in today’s national air navigational system.
While equipment was being developed to guide one plane, both in the air and from the ground, no practical air traffic control system could be placed in operation until equipment and techniques for keeping track of and controlling a number of planes in the air were created, tested and in use.   In addition, the system would have to be able to locate accurately each one in a group of planes in a single, relatively small airspace.   Also it would have to separate them safely in that airspace in all weather, good or bad.
This is true air traffic control.   In one sense, it began back in 1926, when the United States government put forth the first set of air traffic rules.   As previously noted, progress came quickly upon the heels of establishment of the basic rules.   In 1927, some seventeen LF/MF radio ranges were put into operation across the nation.   As one authority said, these were the “highway signs” for the first airways.   These ranges were approved between 1927 and 1929 with the addition of more than seventy-five radio marker beacons.   In 1930, the first two-way radio communication from plane to ground and back went into operation.   Then the element or the human voice was added-a tremendous improvement over the old one-way telegraph key.

The First Control Center

Progress in the young air traffic control field seems to have slackened after 1930.   Research continued, but the results were more difficult to find.   It was not until 1935 that the next major development occurred.   That year the budding commercial airline industry began to realize the need for co-ordination of flight information and joined together in establishing the first control center in the United States.   It was set up by American Airlines at Newark, New Jersey.   Other centers were established within a year at Cleveland, Ohio, and Chicago, Illinois.   The Bureau of Air Commerce, part of the Department of Commerce, assumed control of these three centers on 6 July, 1936.   From then on all centers were operated by the federal government.   Nearly 30,000 aircraft private, commercial and military-were using the nation’s airspace by the end of 1939.
The system put together so laboriously before World War II was crude by today’s standards.   It usually proved ample for the needs of the time, but the war changed all this.   The first major development in air traffic control to emerge from World War II was radar.   Developed largely by the British, it played a major role in winning the Battle of Britain by giving England time to get its Hurricanes and Spitfires up and its anti-aircraft guns ready before each attack.   Continued refinements during and after the war made it possible for radar to be incorporated in the air traffic control system on a small scale by 1947.
Newer and better radar equipment was produced and put into operation as quickly as Congress would approve and allocate the necessary funds throughout the 1950s.   But today, with the 600-mile-per-hour jets flying up to 40,000 feet, even better radar-and more of it-is urgently needed.  Without radar it is doubtful if the commercial airline system the world enjoys today could have been developed.   For during the past twenty years the speed of air travel has increased substantially with the introduction of each new plane.
The DC-3 could cruise at about 180 miles an hour if not loaded too heavily.   Introduction of the DC-4 after the war boosted the cruising speed to over 200 mph for the first time.   The DC-6 and the first tri-tailed Lockheed Constellation increased the limit to nearly 300 mph, and the DC-7 flew at about 365 miles an hour.   Then came the big jets-the Douglas DC-8 and the Boeing 707.   Not only did the speed of commercial airliners increase after the war, but the number of planes in the air and number of new routes they flew also increased tremendously.
